The good news is that the rumblings from the handmade and small business arenas are being heard. The CPSC has decided that it will be practical and listen to all of us out here who can't afford testing and who the CPSC can't regulate in any kind of practical manner.

It's sort of like the health dept and food businesses. There are LOTS of illegal food vendors out there, moms who sell cookies to small catering folks who make stuff in their homes and deliver food to hungry party goers. Much of that is illegal, yet the health dept can't possibly manage regulation of every cook making a buck out there. It just isn't practical. So they just don't bother.

I just heard about this.  It was already a crappy day and now it's gotten much worse.  I suppose this means I'll have to cancel any preorders I have that I've already purchased supplies for.

Has anyone here been informed about a new law that is about to be enacted regarding the selling of anything related to children?

If you make anything to sell that is for children ages 12 and under, after February 10, you will no longer be able to sell unless you get a paper saying that your finished product is certified tested lead free.

At first I thought it was just for clothing, but I have read the new statute that they have put together, and it applies to everything that you sell, including hair accessories, stuffies, toys, clothes, furniture, and so on.

I hope that I have read this wrong.  Here is a link for a group that is advocating to change it.  Good luck to you all.

It absolutely breaks my heart!  I just read about this today over on etsy.  I feel much more safer buying a toy/item for my child from someone who handmade it than to any corporate company.  Your not sitting there second guessing the handmade item.  It's just absolutely heartbreaking.

Now, I have a question (because I haven't seen it on any other website) I make stuff for my kids and do not sell handmade children's items.  Will this apply to those who make children's items as a hobby?

Glad to see this being discussed here.  It sounds like this would effectively put an end to not only sites like etsy but also will mean the end of selling handmade kids' stuff on ebay, at craft fairs, church bazaars, etc.  I imagine it would open craft swaps to potential liability too.

If ever a law was overkill, this is it!

Technically, they shouldn't be able to do anything if you only conduct business within your home state, but the moment you cross state lines, the federal gov't can regulate it.  So craft fairs and the like should still be okay...

Does this include children's clothes as well? Or does it just go for toys? If fabric is purchased from a retailer, shouldn't they be libel for the testing of the fabric? Or does it have to be tested again when we finish the product. I've read some of the literature and I'm still confused.

The way the law is written it affects any item that could come into contact with a child 12 and under. That's why there is so much confusion. The law isn't clear!

I don't know how many of you are reading CPSC central but apparently the first round of revisions was made today and some natural products have been excluded. I'm reading varying reports so don't take my word for it yet but it looks like:
wool, cotton, pearls, and certain gems are being excluded. They're still debating though as we should have more info tomorrow.

List of CPSC accredited testing labs. Must call for quotes specific to your products. Most of these facilities are not in the US. Only 18 of the 88 are in the USA all others are overseas, 15 in Europe and 55 in Asia. Also not all of the labs can test for total lead content, some only test for lead painted, others for small parts & durability, and ONLY a FEW can do the phthalates test. You have to click on the lab name, then on submit to see what that lab is certified by the CPSC to test and issue the certificate of compliance on.
http://www.cpsc.gov/cgi-bin/labapplist.aspx

The law has many gray areas including what is to be considered children\'s items. Here's a Q & A from 1 of the USA based CPSIA certified testing facilities
http://www.strquality.com/www/strlab/industry_expertise/cpsia_faq_html
Realize that they make their profit from testing so they may only have answered in such a way to drum up more business. With that being said it is still one of the only official sites (meaning it is an lab being accredited by the government to interpret the test requirements) that I've seen that answers some questions in a straight forward understandable manner to the public.

A small glimmer of hope for organic fabric (undyed), untreated wood (nonstained or coated), and other natural but unaltered material users :
http://www.cpsc.gov/library/foia/foia09/brief/leadprocedures.pdf
http://www.cpsc.gov/library/foia/foia09/brief/leadlimits.pdf

http://thomas.loc.gov/
Then search: H.R.4040
Consumer Product Safety Improvement Act of 2008 (Enrolled as Agreed to or Passed by Both House and Senate) ~ make sure you read all sections including the references at the end.

The law is ambiguous at best, so be prepared to consult a lawyer as to how this might impact on your business or your ability to buy handmade products for children.
