Swap name: I'll be the photograph that plays your favorite albums back

Limited to a certain number of people? (optional): come one, come all

make sure that every participant has been a member for
at least 1 month:

Details of swap: This mix CD can be anything you want really, just as long as each song reminds you of something. The CD should be atleast 12 songs and the booklet should include a list of songs, what each song reminds you of (dont be a perv though  Wink ) , and if you want, you could even leave some room for the person getting the CD to write down what each song will soon remind them of.

*If you can, try and pick songs from different genres so everyone can find some new bands to listen to.

I hope everyone likes this idea, I think I gave plenty of time for sign up and shipping, so everyone sign up and make my first swapping experence a radical one!

I'm worried about copyright issues for this swap.  Are you going to insist that people rip songs that they no longer own?  In other words, it is illegal (as I understand it) to make a copy of a song to distribute AND keep another copy for your own personal use.

As far as I know, it's only illegal if you profit from making duplicates (at least in Canada)...

Down here in the U.S. I am pretty sure it's only illegal if you are selling it.

And I am repeating thequeenjane's question because I would also like to know.
We are only making one cd right?

CDs come with a warning:

"Federal law provides severe civil and criminal penalties for the unauthorized reproduction, distribution, rental or digital transmission of copyrighted sound recordings. (Title 17, United States Code, Sections 501 and 506). The FBI investigates allegations of criminal copyright infringement and violators will be prosecuted."

It doesn't say anything about profiting via the reproduction.

Now, I'm down here in the United States, so I have no clue about Canadian law.

I'm not trying to be a hardcase, I just know that many of us crafters work very hard on our designs and like to have our own copyrights respected, I'm sure that musicians feel the same way about their craft.

I'd also hate to have craftster get mired in some kind of legal trouble - I'm a member over at booksforsoldiers.org and they've got really strict guidelines about not copying music because the MPAA are pretty rabid about protecting copyright.

If you want to share music illegally - and I'm not gonna stop you - then maybe it would be better to arrange the swap privately.

I'm pretty sure it's OK to make a mix CD as long as you don't sell it to someone. There have already been a few mix CD swaps & no one has gotten in trouble for those.

Isn't it just like if you made a shirt for yourself, or a friend, with a picture of Marilyn Monroe on it? You could give it to someone, just not sell it.

Plus, think of all the mix tapes people have made over the years. We'd all be in trouble!

Yeah, as of now, I was thinking that we could each just make the one CD, but if you want to do more than that, just let me know. Sorry for not putting that in the original post, I thought of it this morning but didnt have time to change it.  Sad

I've never heard of anyone getting in trouble for making mix CDs, but I guess anything could happen.

Sounds like a fun swap, psshimsosass!  I like the idea of leaving room for them to write down their own memories or associations!

Okay, I can't resist.  I have to do it.  Forgive me, please!   Embarrassed  About the copyright issue:  It is copyright violation in the U.S. to make a mix CD and share it, whether or not you are selling it.  If you are going to copy music, it is supposed to be for your own personal use, not for sharing.  Sharing is the same whether you sell it or give it away.

That said, I doubt that anyone is going to get in trouble for swapping a mix CD.  Ethically, it's kind of a gray area ~ adding one song from a CD you paid for to a mix CD isn't the same as ripping the whole CD and just giving it to your friends.  The RIAA (not the MPAA - they're the movie people) are really going after downloaders and illegal music sharers, but my opinion is that sending a mix CD to a friend isn't the same as sharing all of those songs with 9 zillion people over a P2P network.  Sure, the RIAA could still sue me, but I guess that's the risk I take if I join a swap like this.  (I doubt it would be worth their time or effort over one mix CD.  They prefer hunting down users who share or download a lot more than 12 songs.) 

There have been a few successful mix CD swaps, so unless Craftster bans them outright, I think the swap should go on as planned.  Those who disagree with the ethics obviously won't participate.

Now that that whole can of worms is all over the floor...this thread can get back to it's crafty subject.   Cheesy

Thanks for the info angelwing75. i guess i didnt really think about the copyright laws before posting the swap, but personally i dont see a problem with it. i dont like copying whole CDs for people, just cause i have friends in bands and i know how much they depend on the CD sales for money, but they all love mix CDs too, so i think most bands are ok with it.

i completely agree though, if you are worried about copyright laws with this swap, just dont join. Undecided  beyond that, thanks to everyone that has joined so far and everyone that will hopefully join later.
