So.. I was driving today and the name for my shop just kind of fell out of the sky: Kitsch Couture.  I was excited to say the least, and ran home to google it, only to find that it is already taken by a shop in Saratoga.  (And might I add, i LOVE their clothes) But I still really like the name and it doesn't appear to be copyrighted.  Do you think I could just call  it Kitsch Couture by Kelly???

And an aside... do those of you who own an etsy shop and barely make a profit declare that stuff on your taxes?? I'm not looking to make alot of money.. I'm really just planning on breaking about even, but I also don't plan on going to jail for tax evasion.  Thanks!

I'm sure it varies by state, but business names are usually registered in a state or region, not copyrighted.  Of course, big businesses copyright their names (Mattel, Disney, etc.) but local ones do not so someone in another state could name their business the same as mine, but not one in Oregon.  Of course, lines of products or product names are a different story.

I was thinking the same thing as skullgrl.  Couture la Kitsch maybe?  Or why not Couture el Kitsch so you have French, Spanish and German?

You should never go for something existent, especially not when the products are the same or might target the same audience... that is asking for trouble. In addition, you should always register a domain name, and if that is already taken...

I would always pay taxes, though if you are keeping it on a very small scale, it is usually okay to just add it to your income tax instead of registering a business.

Well, I am thinking after inspiration from my beautician asking about making her a one-piece swimsuit, I decided that I want to try to sell some interesting numbers. So here I am asking for some opinions on a website name. I was thinking "Fabulosa". The meaning is fabulous in Spanish and I thought it was a creative move and something catchy. Or if you have any other ideas that would catch some young people's eyes or even possible famous folks, let me know. I plan on registering the site by the end of the week. Thankies! :-)
