I was looking at etsy this morning.  I noticed several items in the crochet section that look very similar to some patterns from the Happy Hooker book.  Is this ok?  It struck me as wrong. I wouldn't want someone else to make things from a pattern I designed and drafted and then sell them as their own.  I just wanted to hear other opinions.

I'm curious about that myself.

However, once you buy a book, doesn't it belong to you with the intent that you will use it as you see fit? I don't know anything about copyright law or publishing, so I'm interested to see what others think as well.

I know the patterns can not be reprodued or sold.  I just don't know about items made from the patterns.

It's a hard line to draw. If they'd never seen the Happy Hooker book and made a pattern themselves that happened to be similar to a Happy Hooker pattern, how can it be a copyright infringement?  However, if they're stating that the pattern is from Happy Hooker, it depends on what Debbie Stoller's copyright statement is.  Some copyright just involves reproducing the pattern, but will freely allow you to sell products of the patterns.  Some try to limit whether you can sell what you make from the pattern.

If you look at it from a sewing perspective, it becomes a bit murkier still because there are a lot of patterns (and people who don't use patterns) that try to copy RTW designs. In fact, the whole point of fashion is to make a fabulous enough design that people want to copy it. 

The only real way to ensure your work isn't made and sold by someone else, though, is either to prosecute every instance you find of it, or don't release the pattern.

Muria - what you said makes alot of sense.  Thanks for putting it in perspective for me.  They didn't state that this was a pattern from the Happy Hooker, but I have this book and have crocheted some of these patterns.  I know some of the people who contributed to this book are on Craftster.  I wonder how they feel about this?

The gist of it is no, you cannot sell an item made from a pattern you did not create, unless you have permission from the maker (author?).  This has been discussed at length.
