Of course they are copywrited. Element probably rakes in millions and millions of dollars a year thanks to the new skateboarding trend and also thanks to bam margera's new found popularity. As long as your not selling these stencilled goods. I don't really think the company minds. Most of my skate gear comes with stencils that are pre-cut and everything. It's like they encourage it. Like I just bougt a pair of circa shoes and on the shoe box the symbols are cut out and in the box are instructions on how to stencil. If you have a west-49 in your town, sometimes they keep stencils under the counter and give them to you when you make purchases. Stenciling is really common with skateboarders, most people use these stencils to stencil their grip tape or skateparks. So if you don't sell your stuff, your clear.
