For those with concerns: I have consulted an attorney on this matter, and because I am not using the words "Nintendo" or "NES" or "SNES" or "N64", etc. on my products (note the packaging, for example, and the fact that none of the cartridges have any company names/Nintendo on them) I am fine; I even have verbiage to make it very clear that I am not licensed nor trying to pass these off as official licensed merchandise, they are just fan created replicas, etc. It's the same reason that digitalsoaps.net is able to create soap in the shape of controllers for popular consoles such as NES, Playstation, and XBOX. They are stated as replicas, not endorsed by the companies - and Digital Soaps has been reviewed and featured on over 1,000 blogs, including CNet and been acknowledged by Nintendo. Like me, their replica controllers have no company names on them + everything comes with proper verbiage, etc. Digital Soaps takes it one step further than I do, however, and they do
use trademarked names on their site - with TM, copyrights, etc. in place. I am playing it safe by using terms such as 8-Bit vs. NES, even though I've been told I am fine.
You'll notice that the Handheld soaps I have up in the pictures DO have "Gameboy" on them, and Nintendo with their TM listed (and on my tags, proper credit is given - verbiage again) but the Handheld soaps are not currently for sale
. I am currently giving them away free, but no money is exchanging hands for the Handheld soaps as I work those details out. What's funny is that I can't even apply for licensing yet, as I don't sell/make enough. Go figure.
